how to serve someone papers on “failure to pay child support” by the courts or get child support?
My wife’s son’s father is not showing up in court for failure to pay child support. It has been two court dates and no show. They keep saying he is not being served so no warrant for arrest. So all he has to do is avoid being served and it’s obvious when a sheriff is coming to your door. A warrant can’t be issued for his arrest until he is served for failure to pay child support. How can we get around this loophole?

If you know his whereabouts and his habits, hire a process server who can serve him in a different place other than his home. In the parking lot where he works, at a place he frequents (bar or wherever he goes with friends), etc. You provide a current photo to the process server and he merely needs to walk up to the person, say his name, and hand him the summons stating “You have been served”. The process server then provides a document stating when and where the person was served. It may cost a few bucks more than a sheriff, but he will never see it coming.
