Do I have to pay the “child support” I pay directly to daycare to my ex if they get pulled out?
In our papers it states under the child support heading that I pay 550 a month directly to daycare. He and his new wife want to pull the kids out of daycare because she is quitting her job. So, he wants me to pay her the 550. I know it falls under the child support heading, but it states that I pay directly to daycare so do I have a leg to stand on? Also, we are joint managing conservators so we have to agree to changes in their education, so don’t I have to agree to pull them out of their daycares?

You don’t have to pay the money to him and the new wife unless they go to court and the court orders it. The order was directly to day care. In fact, I’d call the court and see if I needed to schedule a hearing date to get ahead of their tricks and make sure they understand that you have to agree to any educational changes.

you should have some say so in the matter, it’s not fair that she sit on her @ss all day, and be a mother to u r kids, and u have to pay that much money, i think you should take this back to court..

If I were you, I’d keep paying the daycare and let THEM pay the legal bills that’ll be associated with getting it changed! I don’t know if daycare qualifies as education though…I wouldn’t pay the money directly to them as it might be considered an “informal payment” (your child support order probably specifies this)…FYI, informal payments usually don’t count as child support….
